SUMMARY OF THIRD CLASS ACTION WATER BILLING LAWSUIT RECENTLY FILED

Every account is supposed to pay a separate, flat monthly fee, one for water and one for sewer.

The city has adopted a practice of charging each account a separate monthly fee based on how many water meters each account has. If two or more meters, then there are two or more additional monthly water and sewer fees.

The suit alleges three problems.

First, there is nothing in the ordinance that allows this practice.

Secondly, the city decides, and does not ask property owners how many meters are on their property.

Thirdly, there is no such thing as a sewer meter. Thus the number of water meters should have nothing to do with the flat monthly sewer fees.

Some accounts have up to fifteen water meters and they pay fifteen separate water and sewer fees per month.
