SETTLE SUES CADDO REGISTRAR OF VOTERS FOR VIOLATION OF PUBLIC RECORDS ACT

Dale Sibley has been the Caddo Registrar of Voters since September 2019.

He is a licensed Louisiana attorney who still maintains a private practice of law from the Registrar's Office.

At the recent trial over the results of the Caddo Sheriff November general election Sibley was a key witness. His testimony revealed many problems in the Registrar's Office.

At the trial the testified about the following documents:

1. A "cure absentee ballot flap" form that listed the efforts of his staff to contact a voter who had forwarded an absentee ballot that had defects in the completion of the ballot flap.

2. A "absentee delivery" form that had to be completed by persons delivering absentee ballots to the Registrar's Office.

3. A Policies and Procedures Manual used by the Registrar staff to properly complete their duties.

Sibley has requested to provide these documents in accordance with a Public Records Request from this author. Sibley has classified these documents to be "records" of his office that can only be provided upon a signed request of 25 qualified voters. (La. R.S. 154).

It is the opinion of this writer that this statute applies to voter records, not documents used internally.

The public records request also asked for records of this overtime hours for 2023. Reportedly Sibley would skip most of many work days, coming to this office late in the afternoon. Then he would stay in the office until 6:30 pm, claiming the allowable 1.5 hours overtime. The request asked for the number of 2023 overtime hours and the pay received for the same.

This author believes that pay records are NOT the subject of the statute Sibley relies upon.

A public records lawsuit has been filed by this write against Sibley. A hearing has yet to be set. it unfortunate that a public official has been not forthcoming with basic information that voters are entitled to review. But that is the reputation of Sibley.
