The major lawsuit against the consent decree managers and 32 contractors and subcontractors became public in a newscast yesterday.
This litigation was filed on Sept. 28. --yes, almost a month ago!!
There are many unanswered questions. These include the following:
1. The pleading indicated that service of process on the defendants was to be held, i.e., that the defendants were not to be immediately serve.
Why not serve the defendants ASAP?
2. Why has the mayor not announced this major litigation previously?
3. Why was the lawsuit delayed so long?
The new project manager had advised the council early after being hired that the hydraulic model was defective. This is the real basis of the lawsuit.
4. Did the former project manager and major players in this fiasco have surety and performance bonds?
5. Was the announcement of the litigation delayed to assist the mayor in his re-election bid?
Needless to say, the lack of news of the litigation and the lawsuit itself are topics that bear close scrutiny just days before the Nov. 8 primary.
